AFFIDAVIT
 

Your Affiant, after having been duly sworn under oath, deposes and states that:

I. Ralph Brown, am a Special Agent with the Drug Enforcement Administration (DEA) and have been so employed for a period of approximately two years. During this time I have received extensive training in the investigations of narcotics violations, and have been involved with numerous investigations concerning the sale of narcotics.

Your Affiant states that he has obtained information and evidence that MICHAEL JONES, D.O.B. 3/23/65, who resides at 1463 South Street, Oceana, committed a criminal offense, and does believe that MICHAEL JONES committed a criminal offense, to wit at violation of 21 U.S.C. Secs. 841(a)(1) and 841(b)(1)(B), distribution of more than 500 grams of cocaine, and that probable cause to effect his arrest exists. The following are the facts of this investigation:

1. On August 4, 2003, while on an undercover assignment in the Oceana area, your Affiant purchased approximately 540 grams of cocaine from two suspects in a late model maroon and grey van.

2. Suspect number one was arrested on the scene shortly after completing the transaction described above, and has been charged with a violation of 21 U.S.C. Secs. 841(a)(1) and 841(b)(1)(B).

3. Suspect number two, later identified as MICHAEL JONES, fled from the scene driving the aforementioned van. Your Affiant had an opportunity to view the driver of the van for a substantial period of time during the transaction.

4. After being advised of her rights, suspect number one later identified the driver of the van as MICHAEL JONES.

5. Your Affiant has viewed a recent photograph of MICHAEL JONES and has identified MICHAEL JONES as suspect number two, the driver of the van in the drug transaction described above.

Based on the aforementioned facts, your Affiant believed and does believe that probable cause exists to arrest MICHAEL JONES. As such, your AFFIANT respectfully requests that a criminal complaint be issued for JONES for violation of Title 21, Secs. 841(a)(1) and 841(b)(1)(B), Distribution of a Controlled Substance, to wit, cocaine, the amount of which is greater than 500 grams. Your Affiant asks that this warrant be issued to Ralph Brown or to any Agent of the Drug Enforcement Administration's Oceana Area Task Force.

Your Affiant further sayeth not.
